Terms of service
These Terms of Service ("Terms") govern your use of InputGate (the "Service"), provided by FreeMan LLC ("InputGate", "we", "us"). By creating an account or using the Service, you ("Customer", "you") agree to these Terms.
1. Acceptance
You accept these Terms by clicking "I agree", signing up for an account, or using the Service. If you accept on behalf of an organisation, you represent that you have authority to bind it. If you do not agree, do not use the Service.
You must be at least 18 years old and legally able to enter contracts to use the Service.
2. The service
InputGate provides an API for spam filtering, risk scoring, and content classification on inbound text data. Features may evolve; we will not make a material reduction in functionality without notice.
3. Account
To use the Service you must create an account. You are responsible for:
- Providing accurate registration information.
- Maintaining the confidentiality of your credentials.
- All activity under your account.
Notify us promptly at [email protected] if you suspect unauthorised access.
4. Acceptable use
You agree not to use the Service to:
- Process content that is illegal under applicable law (CSAM, terrorism content, content infringing third-party IP rights, etc.).
- Probe, scan, or test the vulnerability of the Service except as part of an authorised disclosure (see §17).
- Interfere with or disrupt the integrity of the Service or its underlying infrastructure.
- Resell raw API access without explicit written permission.
- Use the Service in a way that violates the rights of any third party.
- Submit content you do not have legal authority to process (e.g. without a lawful basis under applicable data-protection law).
- Use the Service for automated decisions producing legal or similarly significant effects on individuals without your own meaningful review.
5. API keys
API keys authenticate requests against your account. You must:
- Keep keys confidential — never expose them in client-side code, public repositories, or shared logs.
- Rotate keys promptly when team members leave or when compromise is suspected.
- Use a separate key per environment where practical.
We store API keys as SHA-256 hashes only and cannot recover lost keys. Compromised keys can be revoked instantly from the dashboard.
6. Plans & payment
Current plans and pricing are listed at inputgate.cloud/pricing and may change with 30 days' notice for paid plans. The Starter plan is free.
6.1 Billing cycle
Paid plans bill monthly in advance through our payment processor (Stripe). Fees are exclusive of taxes; you are responsible for any applicable VAT, GST, or sales tax. Invoices are emailed and available in the dashboard.
6.2 Refunds
Fees are non-refundable except where required by law. Pro-rata refunds may be granted at our discretion for service interruptions exceeding the SLA (Scale plan and above).
6.3 Failed payment
If payment fails, we will retry over 7 days and notify you. Repeated failure may result in plan downgrade to Starter limits or account suspension.
7. Quota & overage
Each plan includes a monthly request quota counted per user account across all your API keys, on a calendar-month basis (UTC). Once exhausted, additional requests return 429 Too Many Requests immediately — there is no automatic overage billing. Upgrade your plan or wait until the next cycle.
8. Availability & SLA
The Service is provided on a commercially reasonable best-effort basis. Scheduled maintenance windows will be announced where possible.
A formal uptime SLA (99.9% monthly) applies to the Scale plan and above; service credits are detailed in the SLA addendum available on request. Free and Growth plans receive no SLA guarantee, but we work to provide the same operational quality.
9. Customer data
You retain all rights to data you submit to the Service. You grant us a non-exclusive, worldwide, royalty-free licence to process that data solely to provide the Service to you.
We do not use customer submissions to train, fine-tune, or evaluate machine-learning models.
Where you process personal data of end-users through the Service, you are the controller and we act as your processor. The Data Processing Agreement is incorporated into these Terms by reference.
Our handling of personal data is described in the Privacy Policy.
10. Intellectual property
The Service, including its software, models, brand, and documentation, is owned by InputGate and protected by intellectual-property laws. Nothing in these Terms grants you any rights other than the right to use the Service as described.
You may use our trademarks and logo only to refer to InputGate factually (e.g. "Powered by InputGate") — not in a way that implies endorsement or partnership without written consent.
11. Disclaimers
12. Limitation of liability
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for consequential damages, so the above limitations may not apply to you in full.
13. Indemnification
You agree to indemnify and hold harmless InputGate, its affiliates, officers, and employees from any third-party claim arising out of (a) your breach of these Terms, (b) your violation of any law, or (c) content you submit through the Service that infringes third-party rights or violates law.
14. Suspension & termination
14.1 By you
You may cancel your account at any time from the dashboard. Cancellation takes effect at the end of the current billing cycle; no further fees are charged.
14.2 By us
We may suspend or terminate your account immediately if you:
- Materially breach these Terms and fail to cure within 14 days of notice (where curable).
- Engage in fraudulent activity or violate applicable law.
- Pose an active security or abuse risk to the Service or other customers.
14.3 Effect of termination
On termination, your right to access the Service ends. We will retain account data per our retention policy, and customer submission data per the DPA. You may export your account data within 30 days of termination.
15. Changes to these terms
We may update these Terms from time to time. Material changes will be announced by email at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree, you may cancel your account.
16. Governing law & jurisdiction
These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms shall be resolved exclusively in the courts of Cheyenne, Wyoming, USA, except where mandatory consumer-protection law of your country of residence applies.
